Landmark Court Decisions Acknowledge Citizen Rights to a Healthy Climate (Video)

Ordinary citizens including children are using the courts to force governments to act on climate change. A number of lawsuits and some early judgements suggests that the courts may be able to spur significant climate action.

In August a group of 21 children, supported by renowned climate scientist James Hansen, filed a landmark constitutional climate change lawsuit against the federal government.


This lawsuit and others like it argue that weak action on climate change is a violation of the right to life, liberty and property. They assert that the federal government failed to protect essential public trust resources. They further allege that the government's promotion and development of fossil fuels is a violation of the constitutional rights of citizens and young people in particular.

These young plaintiffs are demanding significant reductions in greenhouse gases (GHGs), not only for themselves but for future generations.

As the leading source of GHGs the fossil fuel industry is understandably nervous. If successful this lawsuit and others like it could significantly diminish the prominent role that fossil fuels play in our economy. The fossil fuel industry knows what is at stake so they have come together and filed a joint motion that would allow them to join the Obama administration's fight against the lawsuit. While the children are not expected to win this time there have been successful outcomes in other parts of the world.

A citizen lawsuit in the Netherlands forced the Dutch government to increase its greenhouse gas emissions reduction and set a powerful precedent in the process. This outcome will have implications for the whole of Europe.



Recently, Hallie Turner, a 13 year old girl from Raleigh, filed a law suit in North Carolina to force that state to reduce carbon emissions by at least 4 percent each year.

Another ruling in Washington bodes well for Turner's case and the future of climate change lawsuits across the US. On November 19th in Seattle, Washington, Kings County Superior Court Judge Hollis R. Rill issued a president setting verdict. His ruling upheld the right of young people to demand more cuts to greenhouse gases a a carbon emissions rule from the Washington Department of Ecology. The suit was filed on behalf of eight young people and future generations.

Judge Hill declared: "[the youths] very survival depends upon the will of their elders to act now, decisively and unequivocally, to stem the tide of global warming…before doing so becomes first too costly and then too late...the state has a constitutional obligation to protect the public’s interest in natural resources held in trust for the common benefit of the people."

The is a landmark ruling that will resonate across America. Governments have a "mandatory duty" to ensure a level of air quality that is not injurious to the health of current and future generations. The repercussions of similar judgements elsewhere in America and around the world could prove to be devastating to the fossil fuel industry.

At the very least these lawsuits will add even more pressure on governments to act on climate change at COP21.

Canada's Provincial and Territorial Governments Draft Principles for a Clean Energy Strategy

Canada's provincial and territorial governments have come together and agreed on an energy strategy grounded in clean energy and climate action. At the conclusion of the Council of the Federation meeting in Prince Edward Island on Friday August 29th they released an updated set of principles intended to guide their work on a Canadian energy strategy.

This agreement cites a number of climate friendly initiatives including carbon pricing. The measures were agreed upon by all the provincial and territorial governments including the newly-elected majority governments in Quebec and Ontario.

The principles will serve as the foundation of a strategy that emphasizes cutting carbon pollution and growing Canada’s clean-energy economy.

The climate-friendly energy efforts of provincial and territorial governments are in stark contrast to the ruling federal Conservatives who have been unrelenting supporters of expanded fossil fuel extraction including the tar sands one of the dirtiest forms of energy on earth.

Under Prime Minister Stephen Harper, the Conservatives have amassed a lamentable rap sheet of climate crimes. They have abandoned Kyoto, reneged on the nation's carbon emission reduction pledges, shut down public debates on fossil fuel projects, and prevented scientists from reporting their climate findings.

Canada's Ruling Conservatives Suppress Arctic Ice Loss Research

The ruling Conservative party of Canada under the leadership of Prime Minister Stephen Harper are well known for silencing scientists, cutting funding for environmental research, and gutting environmental oversight. However, their latest attempt to suppress government research on the rapid loss of sea ice in the Arctic has plunged them to a new low.

Conservative ministers are now prohibiting Canadian Ice Services (CIS) from disclosing their research findings. CIS scientists have been denied the right to hold a "strictly factual" press briefing on the catastrophic loss of northern ice. Under the Harper governments new rules CIS and other government researchers must secure nine levels of government approval. The latest attempt to share information paid for by the Canadian taxpayer has been vetoed at the sixth ministerial level.

The Ice loss in the Arctic has implications for global weather patterns. Most recently it has been linked to the drought in California.

The fact that a national government prevents its own scientists from reporting information that has grave global consequences is cynical politically motivated climate denial. The Conservative's goal is to withhold information that can impede their efforts to recklessly extract climate change causing fossil fuels, particularly the tar sands. 

As the temperature keeps climbing around and in the Arctic in particular the Harper government's actions are represent a danger to Canadians, and the whole of human civilization.

Canadian Conservatives Undermine Democracy and Environmental Protections

Canada, once a laudable example of an open democracy is rapidly deteriorating under Harper's Conservatives. There is a long list of anti-democratic actions taken by Canada's ruling Conservatives.  One of those is Bill C-38 which weakened federal environmental laws and made it far more difficult for the public and scientists to weigh in on new projects.

Out of 95 countries surveyed by the Centre for Law and Democracy, Canada ranked 56th, which is one place ahead of Rwanda and behind Colombia, Mongolia and Russia.

When it comes to access to information laws, Canada is behind every country in the world, with the exception of Tajikistan, Australia, Iceland, China and Greece. When it comes to how often information is withheld Canada is the 16th-worst in the world, which is only slightly better than Israel, Pakistan, Portugal and Guyana.

Canada's Conservatives Downgrade Humpback Protection to Move Forward with the Northern Gateway Pipeline

Canada's ruling Conservatives have bent every rule so that they can move forward with tar sands expansion. One of the most egregious and cynical moves involves the downgrading of the protections afforded the North Pacific humpback whales. They are doing this to make it easier to proceed with the $7.9 billion Northern Gateway pipeline project which would ferry tar sands bitumen to transpacific oil tankers off of Canada's ecologically sensitive West Coast.

If it goes forward, the pipeline will transport crude oil from Alberta to Kitimat in British Columbia where hundreds of oil tankers will transport the bitumen overseas.

The humpback whales status has been downgraded from "threatened" to a "species of special concern" under the Species At Risk Act (SARA). This means that the humpbacks, one of the world's largest mammals, are no longer afforded the protections that they had as a threatened species.

As a "threatened" species the humpback would have been a serious obstacle to the building of the pipeline project. As stated in the legislation, "no person shall destroy any part of the critical habitat of any ... listed threatened species".

The humpback is only one of many species at risk from the pipeline. However, whales are in greater danger because of the number of large vessels that could collide with the whales. Whales will also have to contend with oil spills and excessive noise.

Good News for the Environment on Canada Day

The Canadian federal government led by Harper's Conservatives may be notorious for their utter contempt for the environment and unflinching support for fossil fuels, but Canadian provinces and municipalities are putting forth initiatives to meet the challenge of climate change and environmental degradation.

In addition to carbon pricing schemes in some provinces, municipal governments are leading regional efforts to combat climate change in the country. Hundreds of communities across our country are coming together to oppose Harper and protect the people and places that make Canada one of the world's great nations.

In addition to being the first place in North America to completely eliminate coal fired power generation, Ontario has high hopes for environmental legislation with the re-election of the provincial liberals

The Quebec government announced that it will be investing $12-million in a pilot project aimed at putting electric buses on Montreal streets. In October 2013, the Parti Québécois announced that it would invest $516-million to develop an electric vehicle industry in the province that will build electric cars, electric railways, and related infrastructure. The initiative is part of the City Of Montreal’s goal of reducing greenhouse gas emissions by 30 per cent below 1990 levels by 2020.

On the federal level the government is downsizing Canada Post. This is good news for the environment as less mail means less emissions associated with transport and fewer trees destroyed for paper. The need for traditional mail services is declining due to increasing use of electronic communications.

Although ignored by Stephen Harper, some 300 scientists urged the Prime Minister to reject a report that recommended approval of a major oil pipeline to the west coast of British Columbia. The scientists described the report approving the oil pipeline as a “flawed analysis” that downplayed key environmental impacts.

Despite the Harper government's effort to triple the expansion of the tar sands, market forces may also slow the growth of Canada's fossil fuel industry.  Investment in the oil sands have dropped off and there is shrinking foreign investment in Canada's oil patch.

One of the most important pieces of recent environmental news concerns a recent Supreme Court decision that requires approval from aboriginal communities for logging, fossil fuel and mining projects.

Historic Canadian Supreme Court Ruling Dis-Empowers Fossil Fuel Industry

On Thursday June 26th, 2014, the Supreme Court of Canada rendered a ground-breaking decision that recognizes the land claim of a B.C. First Nation. This ruling has national implications and will most certainly impede the rush to exploit fossil fuels and extractive industries in general.

The unanimous ruling granted B.C.'s Tsilhqot’in First Nation title to a 1,700-square-kilometre area of traditional land outside its reserve. However, the decision also sets a game-changing precedent. Going forward, logging, fossil fuel extraction and mining operations on or near aboriginal lands must have the consent from affected aboriginal groups. This has a direct bearing on projects like the Northern Gateway pipeline which crosses four territories with aboriginal claims.

The ruling will have implications that go far beyond B.C. and stretch all the way across the country to Quebec and the East Coast. It will even have repercussions in areas where there are no land treaties.

The Supreme Court decision states that the government has a duty to consult and accommodate First Nations even as the land claim is underway. If the First Nations group does not consent, the government can only go against its wishes if it proves it's justified under the Constitution.

A Not So Happy Canada Day for the Environment

Under Harper's Conservatives, Canada has amassed a lamentable rap sheet of environmental abuses. In addition to failing to meet its GHG reduction commitments the ruling Canadian government has gutted environmental oversight, expanded dirty energy exploitation, killed environmental dissent, silenced climate scientists, withdrawn from the Kyoto protocol and from UN efforts to combat desertification. The Conservatives have even used Canada's intelligence services to spy on peaceful environmental groups.

A Washington-based group, the Center for Global Development, ranked Canada 27th on the environment out of the world's wealthiest 27 countries. Even China the world's largest carbon emitter is improving while Canada continues its downward spiral.

A 2013 national Environics Institute telephone poll in partnership with the David Suzuki Foundation found that public confidence in government as the lead actor in addressing climate change has declined from the 59 percent in 2012 to 53 percent in 2013.

Canada is as obstructionist on the world stage as the Republicans are in US domestic politics. Under the Conservatives Canada has ignored calls to develop a climate policy and accrued a woeful record on emissions per capita, and the development of renewable energy.

Canada has been warming at roughly double the global average over the last six decades and a bad situation is destined to get far worse. According to a Canadian government report, a wide range of flora and fauna have already been negatively affected by the warming trend in Canada.

A federal report submitted to the UN in December 2013 says that in the absence of oil sector regulation Canada’s greenhouse gas emissions will rise sharply after 2020. Canada’s emissions will be 734 megatonnes by 2020, a 5 percent increase from 2011 or 20 percent higher than the target of 612 megatonnes. By 2030 the nation is expected to emit 815 megatonnes, or 33 percent more than its current 2020 target. Emissions from the oil and gas sector will soar by 23 per cent between 2005 and 2020, and by 48 per cent by 2030. The growth of the tar sands are expected to grow Alberta’s emissions by 40 percent between 2005 and 2030, while almost every other province are predicted to see declining levels of emissions.

Carbon intensity has been steadily growing in the tar sands, since at least 2005. From 2005 to 2011, production of bitumen rose 64 percent and the associated emissions of CO2 went up 76 percent. Bitumen production is on course to rise by another 90 percent between 2011 and 2020, and its CO2 emissions will grow even faster, by 105 percent, it forecast. According to the IMF, the ruling Conservatives provide nearly $800 per Canadian in subsidies to the fossil fuel industry.

Canada, the seventh-largest emitter and per-capita emissions in the country are only exceeded by Australia, the US and Saudi Arabia among large polluters.

As reported by Foreign Policy in July last year: "Since the Conservative Party won a majority in Parliament in 2011, the federal government has eviscerated conservationists, indigenous nations, European commissioners, and just about anyone opposing unfettered oil production as unpatriotic radicals. It has muzzled climate change scientists, killed funding for environmental science of every stripe, and in a recent pair of unprecedented omnibus bills, systematically dismantled the country’s most significant long-cherished environmental laws."

It is important to note that Canadian Conservatives have not always been so belligerent and backwards on environmental policy. One Conservative Canadian government even led the world on the battle against acid rain.

Canadian Government Approves Northern Gateway Pipeline Despite Widespread Opposition

The contentious regulatory process for Enbridge's Northern Gateway Pipeline project, which began in May 2010, was finally approved by the government of Canada on Tuesday June 17th. The National Energy Board (NEB) has given the green light to the $7 billion pipeline project that would ferry tar sands bitumen from Bruderheim, Alta., to Kitimat, B.C.

The project is subject to 209 conditions recommended by the Joint Review Panel in In December 2013. However, the panel's independence is questionable given that they approved the project even though 1,159 people spoke against the pipeline at community hearings while only two spoke for it.

The 209 conditions fall into three phases: pre-construction, construction and pre-operation, and ongoing operations. The conditions include watercourse crossings, animal habitat, marine spill prevention and cleanup and shipping agreements. Many of the conditions are administrative, and others contain vague, unenforceable language.

Over 300 prominent scientists expressed a number of concerns about the science in the Joint Review Panel's conditions:
  1. Failed to adequately articulate the rationale for its findings, 
  2. Considered only a narrow set of risks but a broad array of benefits, thereby omitting adequate consideration of key issues, 
  3. Relied on information from the proponent, without external evaluation, 
  4. Contradicted scientific evidence contained in official government documents, and 
  5. Treated uncertain risks as unimportant risks, and assumed these would be negated by the proponent’s yet-to-be-developed mitigation measures. 
Despite widespread opposition from hundreds of scientists, 130 aboriginal groups and millions of Canadians, Natural Resources Minister Greg Rickford declared the project to be "in the public interest." The Northern Gateway pipeline will expand the Alberta oil sands and bring oil supertankers which will imperil B.C.’s rich coastal ecosystems and salmon-bearing streams. The concept of tar sands pipelines are at odds with the wealth of scientific evidence telling us we must eliminate GHGs by weaning ourselves off of fossil fuels.

Northern Gateway's 1,177km pipeline would pump 525,000 barrels of Alberta oil sands bitumen per day, on to 220 super tankers annually in Kitimat on B.C.'s northwest coast. The ships would traverse the Douglas Channel, bound for Asia and California refineries.

Despite the ruling of Harper's Conservatives, efforts to oppose the pipeline are far from over. There are a number of legal challenges. This includes legal challenges to the Conservatives downgrading of species at risk (including the humpback whale) to clear the way for the pipeline project. The Harper government has slashed budgets and eliminated jobs at environment Canada. They have also restricted public comment and even changed the NEB Act in 2012 with the Omnibus Budget Bill (C-38) which eliminated several environmental laws.

Immediately following the ruling, the Environmental Law Centre (ELC) announced that it will file a suit challenging the pipeline’s approval on behalf of the Federation of B.C. Naturalists (B.C. Nature).

In addition to legal challenges a strong majority of people in British Columbia have also demonstrated that they oppose the project. A B.C. group called the Dogwood Initiative has teamed up with aboriginal groups in support of “Let BC Vote,” an effort to allow citizens in the province to vote on the project.

The Premier of B.C., Christy Clark has five conditions which have yet to be met. The BC government does not support the project. Municipalities like Kitimat, Terrace, Prince Rupert and Smithers have rejected the project along with the Union of BC Municipalities which has passed a resolution opposing the pipeline.

Both the leaders of the Federal Liberals and the NDP oppose the pipeline.

"Over 130 First Nations across B.C.? They all say no. Three-hundred scientists? They all say no." Said NDP leader Thomas Mulcair. "The prime minister endorsed this pipeline publicly three years ago. No matter what evidence, how many people speak out, how many people stand up against him, he keeps pushing this project."

Liberal Leader Justin Trudeau said a tanker spill, "would be catastrophic for B.C.'s pristine north coast and its economy."

Construction of the pipeline could begin as early as seven months from now.

US Supreme Court Ruling Makes it Easier to Buy Election Outcomes

A recent ruling by the Republican-appointed majority on the US Supreme Court has freed uber-wealthy to flex their financial muscles so that they can buy electoral outcomes. The ruling on the McCutcheon v. Federal Election Commission case upholds the $2,600 limit per candidate, however, limitations on the number of candidates that can be given money has been lifted. This means that those with the financial means can now interfere with the democratic process.

Some of America's wealthiest people want to stymie government oversight from agencies like the Environmental Protection Agency (EPA). Their goal is to create a pro-business environment which is unfettered by regulation. This includes billionaires who want to pollute, extract fossil fuels or decimate forests.

The true beneficiaries of this court ruling is the Republican party which has become the mouthpiece for irresponsible corporate interests.

With an investment of $1,216,800, wealthy donors can help their candidates in both the House and the Senate races in every election across the country.

This is not the first time the conservative controlled Supreme Court has aided and abetted the wealthy in their bid to buy election outcomes. In a 2010 decision, the Citizens United case overturned limits on independent campaign spending by corporations, unions and Super PACs.

These PACs effectively determined the outcomes in a number Republican primaries in 2013. They also succeeded in pushing out moderate candidates.

US Senators Climate Change Slumber Party
On the night of March 10 into the morning of March 11, Democratic and Independent US Senators pulled an all-nighter to discuss climate change. A total of 28 Senators spoke all night to urge action on climate change.

“Climate change is real, it is caused by humans, and it is solvable,” said Senator Schatz, he went on to say why he was participating in the climate change slumber party: “Congress must act. On Monday night we’re going to show the growing number of Senators who are committed to working together to confront climate change,” Schatz said.

Senator Boxer said: “So many Senators coming together for an all-night session shows our commitment to wake up Congress to the dangers of climate change. All you have to do is look at China to see what happens to your country when you throw the environment under the bus.”

"The cost of Congress' inaction on climate change is too high for our communities, our kids and grandkids, and our economy," Senator Whitehouse said. "On Monday we’ll be sending a clear message: it’s time for Congress to wake up and get serious about addressing this issue."

Democrats May Have Renewed Interest in Tackling Climate Change

We may be seeing renewed interest in climate change advocacy from Democrats. While Republicans have made their contempt for climate change legislation known, many Democrats are also guilty of dereliction of duty on the subject of climate change. Four years ago there were not enough votes in the Democrat controlled Senate to move forward with climate change legislation.

Senate Majority Leader Harry Reid recently told reporters that, "Climate change is the worst problem facing the world today." This is a reiteration of comments he made last June, when he said in a speech on the Senate floor that "we have no more important issue in the world than this issue, period."

Rhode Island Democrat Sheldon Whitehouse said Reid's climate remarks are evidence that the profile of the issue has "climbed considerably."

To illustrate the point at least 26 Senate Democrats and two independents staged a climate awareness slumber party on the night of Monday March 10th with the message that "its time for Congress to wake up and get serious about addressing [climate change].

Event - Making Waves: The Second Annual Canadian Association of Environmental Law Societies (CAELS) Conference

The Environmental Law Conference will take place on February 21 - 22, 2014 at the University of Ottawa’s new Faculty of Social Sciences building in Ottawa, Ontario. The Canadian Association of Environmental Law Societies (CAELS) is an exciting new networking project connecting environmental law students across the country.

The second annual CAELS conference will focusing on Canadian environmental law issues. The conference will bring together law students, academics, and practitioners from around the country to learn and network. This student-run conference will feature keynote addresses from Gord Miller (Environmental Commissioner of Ontario) and Maude Barlow (Council of Canadians). In addition, the conference will have multidisciplinary panels of speakers featuring graduate students, practitioners, and academics.

Environmental law requires expertise in a broad variety of disciplines, from physics and biological sciences to law and policy to social movements. Panels will reflect this diversity. This event will allow CAELS to further establish itself as a forum for students and professionals in Ontario and Canada who are interested in the development and study of environmental law.

The Environmental Implications of the US Omnibus Spending Bill

A new spending bill may have bipartisan support but it has both good and bad implications for the environment. On Monday January 12, 2013, the House and Senate appropriations committee chairs announced that they had agreed on an omnibus appropriations bill (FY14). The bilateral agreement put together by House Appropriations Chair Hal Rogers (R-Ky.) and Senate Appropriations Chair Barbara Mikulski (D-Md.) allocates $1.012 trillion in federal spending.

On the upside environmentalists successfully fended off Republican attempts to reduce funding for the Environmental Protection Agency (EPA) that would have impeded the agency's efforts to regulate greenhouse gases (GHGs).

But environmentalists were disappointed that the inefficient incandescent light bulb was saved by the bill. The bill stops energy efficiency regulations imposed during George W. Bush's administration and continued under President Obama that would have phased out incandescent light bulbs in favor of more efficient lighting like LEDs.

The spending legislation will also put an end to the proposed high-speed rail project in California. Finally only a portion of the scientific research funding cut by sequestration is restored by the bill.

Canadians love the plethora of natural beauty that surrounds them but Canada is at the bottom of the OECD list on environmental performance. Canada is one of the last pristine wild places on earth. The nation is home to 20 percent of the world's fresh water and 20 percent of the world's natural forests but our environmental protections have been systematically eroded by Harper's Conservatives.
We can change this woeful state of affairs by enshrining a healthy environment in our constitution. In over 100 countries around the world a healthy environment is already the law. Top Canadian Environmental Defense Issues in 2013

This report from Environmental Defense reviews some of the top Canadian environmental stories of 2013.

Environmental Defence has been working since 1984 to protect Canadians' environment and human health. They have accomplished a great deal in the last 30 years.

They are Canada's most effective environmental action organization. They seek to create a world Canadians are proud to pass on to their children. To bring this about they challenge and inspire change in government, business and people to ensure a greener, healthier and prosperous life for all.

Here are some excerpts from the report including the section on Highlights and the section on Energy.


Highlights


No More Escarpment Blues

After eight years, and much hard work, along with our partners, Protecting Rural Escarpment Land (PERL), we were thrilled with the Joint Board’s decision to protect Burlington’s Mount Nemo this year. The decision denies Nelson Aggregate’s proposed 26 million tonne quarry on an 82 hectare site. It will give Mount Nemo and its rare and endangered species a chance to breathe after a century of quarrying. The decision will also protect the unique ecological functions of the Escarpment, which cannot be replaced by planting trees nearby, as was originally proposed by Nelson Aggregates to offset its negative environmental impact.

A Blue Flag for the Sea-Bound Coast

This year, the prestigious Blue Flag went east. In cooperation with the community of Dartmouth, we raised the first flag on a beach in Nova Scotia. Birch Cove beach is now one of 18 beaches and four marinas receiving a Blue Flag in 2013. Communities in British Columbia, Manitoba, Ontario, and Quebec are also proud of their clean, green beaches and marinas. The Blue Flag recognizes beaches and marinas that meet strict standards, including water quality and environmental education. Now that’s something worth celebrating!

Ontario’s Greenbelt Gets Bigger

It’s been eight years since Ontario’s Greenbelt was born, and it just keeps getting bigger and stronger. This year, Oakville’s Glenorchy Conservation Area was added to the Greenbelt, which marked the first expansion since the Greenbelt’s creation in 2005. Considered an environmentally sensitive area, Glenorchy includes hills, forests, creeks, and wetlands that are now protected from sprawl and development. We also commemorated eight years by releasing a report with the Ontario Greenbelt Alliance. Good Things Are Growing in Ontario: Expanding Ontario’s Greenbelt Through Urban River Valleys shows how over five million more Ontarians will be directly connected to the Greenbelt if it expands along some of the province’s best known rivers and creeks. This is now a possibility, thanks to the province’s new urban river valley designation announced in January.

So Many Green Journalists!

Canada’s youth stepped up again this year to reveal their writing, photography, and videography talents. 2013 saw more entries in ourCanada’s Next Green Journalist competition than ever! And, four Canadian youth moved up to the international Litter Less competition, which encourages youth from around the world to submit their multimedia solutions for reducing litter. Congratulations to this year’s Canadian winners: Rajbalinder Ghatoura, Kristen Rodrigo, Lovely Juson, and Spencer Woolf, whose work was up against entries from 19 other countries.

Celebrity Partners

We made a lot of new friends this year, and some of them are making us famous! Our Celebrity Partners lend their time, skills, passions and energy to raise awareness about various environmental issues and support the work of ENVIRONMENTAL DEFENCE. From actors and musicians, to television personalities and activists, we’re pleased to count these well known individuals, like Randy Bachman, Bruce Cockburn, Sarah Slean, Gill Deacon, Kari Matchett, and Sarah and Tamara Podemski, among our supporters.

Flamborough Quarry Proposal Put to an End 

Let’s hear it for our partners and Ontario Greenbelt Alliance members, Friends of Rural Communities and the Environment (FORCE), who have some celebrating to do after the Ontario government and St. Marys Cement reached an agreement to end the Flamborough quarry proposal. After a nine year fight, FORCE was successful in achieving a conservation covenant that extends to all proposed quarry lands and prohibits any aggregate extraction. In addition, a large portion of the area will be designated as a protected area and given even more use restrictions.

Energy

They say there’s no use beating a dead horse. With no federal regulations on greenhouse gas pollution from the tar sands—Canada’s fastest growing source of emissions—and the federal government backing the oil industry to push oil pipelines on both sides of the country, the hope of addressing climate change in Canada could easily appear to be a very dead horse.

Of course, at ENVIRONMENTAL DEFENCE we know the conversation on climate isn’t over, and so do Canadians. We know we can build an economy that isn’t destructive to the environment, one that is cleaner, greener and prepares all Canadians for the transition to a sustainable future.

Instead of building pipelines and tankers to carry dirty oil across our precious land and water, we’ve been working to promote clean energy solutions, and the thousands of jobs that go along with them. And, we’ve done so in partnership with communities, First Nations, unions, academics, economists, and scientists, to name a few.

Communities like those in British Columbia, whose voices were heard loud and clear about the proposed Northern Gateway tar sands pipeline and tanker project in May. We were delighted by B.C.’s responsible decision to reject Enbridge’s risky proposal. If built, the pipeline would carry 100 million tonnes of carbon pollution each year, the equivalent of putting 18 million cars on the road. By listening to residents and people across Canada, B.C. made an important move to protect the rights, environment and health of Canadians over the narrow interests of oil companies.

Of all the pro tar sands rhetoric out there in Canada, perhaps some of the toughest to swallow promotes the economic benefits of expanding the tar sands. That’s why we released More Bang for our Buck: How Canada can create more energy jobs and less pollution, with our green economy partners, Blue Green Canada. The report shows how Canada’s increasing reliance on the oil sands is not the best strategy for the economy or our environment. If the $1.3 billion in government subsidies now given to the oil and gas sector were instead invested in renewable energy and energy efficiency, Canada would create 18,000 more jobs, and also diminish the economic risks of relying increasingly on the volatile oil market.

The same goes for the risky Line 9 pipeline, proposed to run through Ontario and Quebec. The proposal to ship potentially more dangerous tar sands oil through an old pipeline that crosses every river flowing into Lake Ontario on the Canadian side, and runs directly through the most populated part of Canada, is extremely risky.

If you live in Ontario, you’ve probably seen evidence of our work to stop Line 9. We’ve spoken with thousands of residents along the proposed pipeline route, and our “Stop Line 9” lawn signs can be seen in front of homes from Kingston to Hamilton. In January, we worked with groups across Ontario, Quebec, and New England to support a Day of Action on Line 9 and say no to tar sands oil being shipped through our communities. And then, in May, we drew attention to the National Energy Board’s (NEB) new rules requiring members of the public to submit a resume and references as part of a 10 page application form, just for permission to submit a letter to the NEB. These rules appear intentionally designed to prevent public participation in hearings about new energy projects, such as the Line 9 pipeline project.

We encourage all Canadians to be concerned about what’s happening in their home community, no matter what’s on their resume. And, ENVIRONMENTAL DEFENCE is also actively supporting the type of energy development we do want. We were happy that the Ontario government announced in July that it wants to put energy conservation first when planning to meet the province’s energy needs. That means more money, more jobs and less pollution. Not a bad deal. We’ve also seen more green energy projects built in Ontario this year. Our priority is to make sure the province sticks with a strong plan to go green. All in all, the call for a new way of thinking about energy in Canada is strong. We’re proud to lead this effort, and will continue to push for a national clean energy strategy..
